1. Application of these Terms
These Terms of Use apply when you access or use the Insources website, online portals or other digital properties operated by Insources Group Pty Ltd.
By using the website, you agree to these Terms. If you do not agree, you must stop using the website.
You must be at least 18 years old to make a purchase or enter into an agreement in your own name. A person under 18 may use authorised training services with any consent or supervision required by law.
2. Relationship with Other Terms
These Terms govern general website access and use.
Purchases, subscriptions, training programs, licensed resources, consulting services and research projects are governed by the Insources Terms of Sale & Subscription and any applicable quotation, proposal, statement of work, order confirmation or licence.
If there is an inconsistency concerning a purchased product or paid service:
- a signed contract or statement of work prevails;
- an accepted quotation or proposal prevails next;
- the Terms of Sale & Subscription prevail; and
- these Terms apply only to general website use.
These Terms do not retrospectively change an existing purchase, subscription or service agreement.
3. Permitted Website Use
Insources grants you a limited, non-exclusive, revocable and non-transferable right to access and use the website for lawful personal or business purposes.
You may view, print or download publicly available website content for internal reference, provided you retain all copyright and proprietary notices.
Purchased products, training materials, subscription content and consulting Deliverables may only be used in accordance with the applicable licence or agreement.
4. Prohibited Conduct
You must not:
- use the website unlawfully, fraudulently or in a way that harms another person;
- attempt to gain unauthorised access to accounts, systems, data or restricted areas;
- introduce viruses, malicious code or harmful technology;
- scrape, harvest, copy or extract website content using automated tools without written permission;
- interfere with the operation, security or availability of the website;
- impersonate another person or misrepresent your identity or authority;
- upload unlawful, misleading, defamatory, discriminatory, abusive or infringing content;
- remove or alter copyright, trade mark or proprietary notices;
- reproduce, sell, sublicense or commercially exploit website content without written permission; or
- use Insources content to develop or supply a competing commercial product without authorisation.
5. Accounts and Credentials
Each individual login may be used only by the person to whom it is assigned.
An organisational, multi-site or enterprise arrangement may permit multiple separately authorised users in accordance with the applicable licence or agreement.
You must:
- keep login details confidential;
- use accurate and current account information;
- prevent unauthorised access; and
- notify Insources promptly if you suspect that an account has been compromised.
You are responsible for activity carried out through your account to the extent caused by your failure to protect your credentials.
6. Website Content and Intellectual Property
Unless otherwise stated, the website and its content are owned by or licensed to Insources.
This includes text, articles, graphics, photographs, videos, logos, software, code, page layouts and website design.
Nothing in these Terms transfers ownership of Insources intellectual property to you.
These general website restrictions do not override a licence granted under the Terms of Sale & Subscription or another written agreement.
7. User Submissions
Where the website allows comments, reviews, questions or other public submissions, you must have the right to submit the material and must not include confidential, unlawful or infringing content.
You grant Insources a non-exclusive, royalty-free licence to host, reproduce, display and technically process the submission only as reasonably necessary to operate and moderate the relevant website feature.
This licence does not apply to:
- client Confidential Information;
- materials submitted through a paid course or secure client portal;
- consulting-project information;
- learner evidence;
- research data; or
- content governed by another agreement.
Insources may remove or restrict access to content that it reasonably believes breaches these Terms or applicable law.
8. Responsible Use of Artificial Intelligence
The website may include or connect with artificial intelligence, automated decision-support, generative AI, chatbot or similar technologies.
You must use any AI-enabled feature lawfully, responsibly and only for its intended purpose.
You must not:
- submit personal information, sensitive information, Confidential Information or third-party material unless you have authority to do so;
- use an AI-enabled feature to produce unlawful, misleading, discriminatory, abusive, unsafe or infringing content;
- attempt to bypass safeguards, extract system instructions, access restricted data or interfere with security controls;
- represent AI-generated output as verified legal, regulatory, compliance or professional advice;
- use AI-generated content without checking its accuracy, suitability and lawfulness; or
- use Insources content, resources or data to train, fine-tune or develop an external AI model without written permission.
AI-generated outputs may contain errors, omissions, bias or outdated information and do not replace professional judgement.
Insources may restrict or suspend access to an AI-enabled feature where continued use creates a legal, privacy, security, safety or intellectual-property risk.
Personal information processed through an AI-enabled feature will be handled in accordance with the Insources Privacy Policy and applicable law.
9. External Websites and Services
The website may contain links to third-party websites, platforms, advertisements or services.
Unless expressly stated, Insources does not control or endorse those third parties and is not responsible for their content, availability, security or practices.
Your dealings with an independent third party are governed by that party’s terms.
Where a third-party platform is used by Insources to deliver a paid product or service, the Terms of Sale & Subscription and applicable service agreement also apply.
10. Website Availability and Security
Insources takes reasonable steps to maintain the website and protect information submitted through it.
However, internet transmission and website availability cannot be guaranteed to be uninterrupted, error-free or completely secure.
You are responsible for protecting your devices, systems, networks and credentials.
Specific access periods, outage remedies or service commitments for paid platforms, courses and subscriptions are governed by the Terms of Sale & Subscription.
11. Privacy
Insources handles personal information in accordance with its Privacy Policy and applicable law.
By using the website, you acknowledge that information may be collected for purposes including:
- managing accounts;
- responding to enquiries;
- processing registrations and purchases;
- delivering services;
- improving website functionality; and
- meeting legal obligations.
12. Suspension and Termination
Insources may remove content or suspend website access where reasonably necessary to address:
- unlawful activity;
- fraud;
- serious misconduct;
- security risks;
- malicious activity;
- intellectual-property infringement; or
- a material breach of these Terms.
Where appropriate, Insources will provide notice and a reasonable opportunity to remedy the issue.
Suspension or termination of a paid product, subscription or service is governed by the Terms of Sale & Subscription.
When access ends, you must stop using content you are no longer licensed to retain. This does not apply to materials you are entitled or required to retain under another agreement or law.
13. Consumer Rights and Liability
Nothing in these Terms excludes, restricts or modifies any guarantee, right, remedy or liability that cannot lawfully be excluded, including under the Australian Consumer Law.
To the extent permitted by law, Insources is not liable for indirect or consequential loss arising solely from general use of, or inability to access, the public website.
This limitation does not override any specific liability or service obligations contained in the Terms of Sale & Subscription or another agreement.
14. Changes to these Terms
Insources may update these Terms by publishing a revised version on the website.
Updated Terms apply prospectively from their stated effective date.
They do not retrospectively amend an existing purchase, fixed-term subscription, accepted quotation, statement of work or other agreement unless:
- the parties agree; or
- the change is required by law.
15. Governing Law
These Terms are governed by the laws of New South Wales, Australia.
The parties submit to the non-exclusive jurisdiction of the courts of New South Wales and courts entitled to hear appeals from them.
